Eric Raasch explained the nine variance requests stem from homes built without the stem walls shown on plans, requiring low retaining walls that encroach into setbacks; noted single-wall designs best protect drainage. February 3, 2026 City Council Meetin g Minute s Page 6 of 8 Mayor Kelley raised concerns about why stem walls were not built, how inspections allowed it, whether walls were permitted properly, and why issues were caught so late; suggested Pulte might need to rebuild stem walls on lots they still own; stressed accountability. Aaron Struckmeyer acknowledged plans showed stem walls but the requirement never made it into the field set; said retaining walls were permitted and installed before COs but lacked exact dates and details; said construction leadership would need to answer technical questions. Councilor Hernandez noted some homes are occupied; asked about buyer disclosures and inspection responsibility; said the City may need different approaches for occupied vs. builder-owned lots. Aaron Struckmeyer said contracts do not specify foundation types; confirmed retaining walls were installed pre-CO but could not confirm inspector type without construction team input. Mayor Kelley requested original engineering plans, as-builts, permits, CO files, and direct testimony from Pulte decision-makers; insisted residents be notified and allowed to participate. 4 Public Comment David Yeager, 2750 Purple Meadow Ct., reported firsthand drainage issues at Del Webb model homes and ongoing lot-grading problems, supporting the council's scrutiny of the variance requests. Item 13: Bid Award - Wastewater Treatment Plant Construction Manager at Risk (CMAR) Mark Johnson explained that hiring a construction manager at risk (CMAR) for the wastewater treatment plant expansion would be beneficial because they can get involved early in the design process potentially value engineer some of the work, and help speed up the project. Although several companies inspected the site, they received only one bid from Vogel Brothers Building Company. Scott Gerken clarified that this was a request for qualifications (RFQ), and the actual contract would come back to the council for approval with the cost being a percentage of the total project.
